Consignment Promotion Terms

These Consignment Promotion Terms ("Promotion Terms") are issued by SC Cards & Collectibles LLC, a New Jersey limited liability company (the "Company"). They govern every consignment promotion the Company offers, including Consignment Credits and Consignment Fee Discounts. Each specific offer is described in a Promotion Offer, and these Promotion Terms apply to all of them.

1. Relationship to Other Agreements

1.1 Part of the agreement. These Promotion Terms are the Consignment Promotion Terms referred to in Section 17.1 of the Company's Exclusive Consignment Agreement (the "Consignment Agreement") and in the Terms of Service. For any Promotion the consignor accepts, they are part of the Consignment Agreement under that Section 17.1, and they work together with the Terms of Service and the Privacy Policy. They apply to a Consigned Item only when a Promotion has been accepted for it.

1.2 Order of precedence. For a specific Promotion, its Offer Details control over these Promotion Terms if the two conflict, and these Promotion Terms control over the Terms of Service, as Sections 12, 17, and 34 of the Terms of Service provide. The Consignment Agreement controls over both, except that a Promotion may reduce the Consignment Fee, or apply a credit against it, as these Promotion Terms describe and Section 17.1 of the Consignment Agreement allows.

1.3 No change to core terms. A Promotion changes only the Consignment Fee charged or the credit applied on Qualifying Items. It does not change listing decisions, marketplace selection, listing format, pricing, intake standards, item eligibility, payout timing, or payment methods under the Consignment Agreement.

1.4 Other programs. Giveaways, contests, sweepstakes, and referral programs are governed by their own rules. They are not Promotions under these Promotion Terms unless their rules say so.

2. Definitions

Capitalized terms not defined here have the meanings given in the Consignment Agreement, including Consignment Fee, Consigned Item, Consignment Form, Consignment Period, and Net Payout Balance.

  • Promotion: any Consignment Credit, Consignment Fee Discount, or other consignment incentive the Company offers under these Promotion Terms.

  • Promotion Offer: the specific written description of a Promotion, delivered only by email, website page, consignor portal notice, social media post, text message, printed insert, or QR code. Its specific terms, listed in Section 4.6, are its "Offer Details," which form part of these Promotion Terms.

  • Promotion Code: a code, link, or QR code that identifies a Promotion Offer.

  • Promotion Period: the period stated in the Promotion Offer during which a Promotion can be accepted or earned and items can be shipped to qualify. Every Promotion Offer states its Promotion Period, as described in Section 4.7.

  • Consignment Credit: a promotional dollar amount applied against the Consignment Fee owed to the Company, as described in Schedule A.

  • Consignment Fee Discount: a reduction to the Consignment Fee rate under the Consignment Tiers, as described in Schedule B.

  • Consignment Tiers: the standard Consignment Fee rates in Section 5.1 of the Consignment Agreement. An item's tier is set by its gross sale price, and the rate is applied to its Net Sale Proceeds.

  • Intake Verification Date: the date the Company completes its physical inspection and verification of a Consigned Item, as described in Section 1.4 of the Consignment Agreement. Carrier delivery alone does not set an Intake Verification Date.

  • Qualifying Item: a Consigned Item that has an Intake Verification Date, has not been declined under Section 1.5 or 1.7 of the Consignment Agreement, and meets every condition in the Offer Details. Items intentionally sold together as one lot are one Qualifying Item.

  • Account: a consignor's registered account with the Company, including the consignor portal account.

3. Eligibility

3.1 Who can receive and redeem an offer. A Promotion Offer may be sent to anyone, including people who have never consigned with the Company and do not yet have an Account or a signed Consignment Agreement. Receiving an offer creates no obligation, and a person may accept a Promotion before registering an Account or signing the Consignment Agreement. A Promotion applies only if the person completes the registration, approval, and signing steps below before the related items are shipped to the Company. To redeem a Promotion, the recipient must:

  • be at least 18 years old, or the age of majority where they live, if higher. A parent or legal guardian who consigns items owned by a minor receives any Promotion in their own name.

  • register an Account and be approved by the Company

  • sign the Consignment Agreement

  • have no unresolved amounts owed to the Company and no open violations of the Consignment Agreement or Terms of Service

  • meet any additional requirements in the Offer Details, such as being a new consignor, submitting a minimum number of items, or using a specific Promotion Code

3.2 One Account per consignor. Each person or business may hold one Account.

3.3 New and lapsed consignors. If a Promotion Offer is limited to new consignors, it applies only to a person or business that has never had an Account or a prior consignment with the Company. If an offer is limited to lapsed consignors, it applies only to a person or business that has had an item accepted for consignment by the Company in the past, but none during the period stated in the Offer Details.

3.4 Location. The Company may accept consignors outside the United States, but a Promotion Offer may be limited to certain countries or states. A Promotion is void where prohibited by law. It is not available to anyone the Company cannot do business with under U.S. sanctions or export-control laws.

3.5 Company discretion. Approving an Account or accepting items for consignment remains at the Company's discretion under Sections 1.3, 1.5, and 1.7 of the Consignment Agreement. Holding a Promotion Code does not guarantee that an Account or any item will be accepted.

3.6 Company personnel. The Company's Managing Member, employees, and contractors, and members of their households, are not eligible for Promotions unless the Managing Member approves in writing.

3.7 Personal and public offers. A Promotion Code sent to a specific person may be redeemed only by that person, and the Company may refuse it if anyone else tries to use it. A Promotion Code posted or printed for general use, such as on the Company's website, on social media, or on a printed insert, may be used by anyone who meets the eligibility requirements. Either way, each person may redeem a Promotion Code only once unless the Offer Details say otherwise.

4. How Promotions Are Offered, Accepted, and Applied

4.1 Offer. A Promotion Offer may be general, such as a website page, social media post, printed insert, or QR code that carries a Promotion Code, or sent to a specific person. Email offers are sent only as described in Section 10.4, and text offers only as described in Section 10.5.

4.2 Acceptance. A recipient accepts a Promotion by entering its Promotion Code, selecting it in the consignor portal, signing an acknowledgment, replying by email or on social media, or any other method the Company accepts or the Offer Details state. In the consignor portal, the consignor confirms acceptance of these Promotion Terms by checking a box when entering the code. Acceptance, including entry of any required Promotion Code, must be given at registration or before the related items are shipped to the Company, unless the Company agrees in writing to a later time. The Company keeps a dated record of each acceptance, including the message when acceptance is given by email or on social media and the Offer Details as they stood when the Promotion was accepted, and that record applies to that Promotion.

4.3 When a Promotion applies. A Promotion applies only to Qualifying Items that the consignor ships to the Company during the Promotion Period, as shown by the carrier's tracking record. The timing of the Company's intake does not affect eligibility, but an item that never receives an Intake Verification Date does not qualify. An item shipped by a third party on the consignor's behalf, as described in Section 1.3 of the Consignment Agreement, counts as shipped by the consignor.

4.4 How it is applied. The Company applies a Promotion when an item sells and is settled under Section 6 of the Consignment Agreement. The Promotion appears as a separate line on the consignor's settlement statement. The statement also shows the Promotion's reference code, the standard Consignment Fee rate and amount, and the Consignment Fee actually charged. The rest of the statement is as described in Section 6.5 of the Consignment Agreement.

4.5 Errors. If a Promotion is missed or applied incorrectly, including because of a technical problem outside the Company's reasonable control, the Company will correct it on the next settlement statement once it confirms the error. A consignor who believes a Promotion was missed or misapplied must notify the Company in writing within thirty (30) days after the settlement statement is provided, which is the review period in Section 6.5 of the Consignment Agreement.

4.6 Offer Details. Each Promotion Offer will state, as applicable:

  • the type of Promotion and its value

  • who may use it, such as new consignors, lapsed consignors, or the specific person it was sent to

  • the Promotion Code, if one is required, and when it must be entered

  • its Promotion Period, as start and end dates or as a period measured from when the offer was sent

  • the expiration date of any Consignment Credit or Consignment Fee Discount

  • any minimum, such as a number of items or a minimum sale price per item

  • any maximum, such as a cap on value per item, per consignor, or across the offer

  • any limit on how many people may use it

  • any excluded tiers, item categories, or sales channels

  • a reference code that identifies the offer on settlement statements

Offer Details may appear in the offer itself or on a web page the offer links to, such as the page a printed insert's QR code opens. If an advertisement, printed material, social media post, or other summary of an offer differs from the Offer Details, the Offer Details control.

4.7 Dates and times. All dates and times in these Promotion Terms and in Offer Details are in Eastern Time (ET) and follow U.S. daylight saving time. Unless the Offer Details say otherwise, a Promotion Period starts at 12:00:00 a.m. on its start date and ends at 11:59:59 p.m. on its end date. If a Promotion Period is measured from when an offer was sent, it runs from the date the Company sent it to that recipient, so two recipients of the same offer may have different end dates.

4.8 Not retroactive. A Promotion does not apply to sales completed before it was accepted or to any earlier consignment.

4.9 Official offers only. A Promotion Offer is valid only if it is sent from the Company's designated email addresses or business phone number, or posted on the Company's website, consignor portal, or official social media accounts, or printed on an insert or other material the Company issues, including a QR code that links to one of those pages. Anyone can confirm an offer at consignment@sccardscollectibles.com. Only the Company's Managing Member may approve a Promotion that differs from a published offer.

4.10 Examples are illustrations. Examples and payout percentages in a Promotion Offer are illustrations only. Actual results depend on each item's gross sale price, Net Sale Proceeds, and Consignment Fee.

5. General Promotion Rules

5.1 No cash value. Promotions have no cash value. They cannot be redeemed, withdrawn, or paid out as cash, store credit, or merchandise, and they are not part of the consignor's Net Payout Balance. They cannot be used toward purchases from the Company on any sales channel.

5.2 Not transferable. Promotions belong to the person who accepted them and attach to that person's Account once it is opened. They cannot be sold, transferred, shared, or combined between people or Accounts.

5.3 No stacking. Unless the Offer Details expressly allow it, only one Promotion applies to any single item, so a Consignment Credit and a Consignment Fee Discount cannot be used on the same item. If more than one Promotion could apply, the Company applies the one with the greater value to the consignor.

5.4 No negative Consignment Fee. A Promotion cannot reduce the Consignment Fee on an item below $0.00, and cannot increase the consignor's payment for an item above its Net Sale Proceeds.

5.5 Consignment Fee only. Promotions apply to the Company's Consignment Fee only. Unless the Offer Details say otherwise, they do not reduce any deduction used to determine Net Sale Proceeds under Section 5.2 of the Consignment Agreement, any amount deducted or set off under Sections 6.3, 6.7, or 9 of the Consignment Agreement, or an item for which the Consignment Form states a different Consignment Fee rate. They also do not reduce these charges under the Consignment Agreement: the Consignment Fee owed under Section 2.5, 2.7, or 3.6; the withdrawal fee or reimbursements under Section 14.4; the re-sleeving fee under Section 1.7; or storage fees under Section 14.5.

5.6 Expiration. Each Promotion expires on the expiration date stated in the Offer Details, and every offer that gives a Consignment Credit or Consignment Fee Discount states one. Any other Promotion expires when its Promotion Period ends. Expired Promotions cannot be reinstated, except as stated in Section 6.

5.7 Quantity limits. When a quantity limit stated in the Offer Details is reached, the offer closes, even if it is still visible on a website, post, or message.

5.8 Currency. Promotion values are stated and applied in U.S. dollars, as provided in Section 6.6 of the Consignment Agreement.

6. Withdrawals, Reversed Sales, and Account Closure

6.1 Withdrawn or returned items. No Promotion applies to an item that is withdrawn, returned to the consignor, or does not sell. If a Promotion was earned by submitting a minimum number or value of items, and withdrawals bring the consignor below that minimum, the Company may cancel the unused portion of the Promotion.

6.2 Reversed sales. A sale voided before payment under Section 9.2 of the Consignment Agreement carries no Consignment Fee, so no Promotion is used on it. If a sale is reversed after payment under Section 6.3 of the Consignment Agreement, the Consignment Fee is reversed with it, and any Consignment Credit used on that sale is restored to the Account if it has not yet expired. When the Company bears a loss under Section 9.6 or 9.7 of the Consignment Agreement, no Consignment Fee is charged and no Promotion is used. A Consigned Item relisted under Section 9.2 of the Consignment Agreement keeps its Promotion for the extended Consignment Period.

6.3 Account closure or termination. If an Account is closed by either party, or the Consignment Agreement ends, unused Promotions are forfeited, except when the Company ends the Consignment Agreement for its own convenience under Section 14.1 of that Agreement. In that case an unused Promotion stays valid until it expires under Section 5.6 and may be used on a later consignment. A Promotion already applied to a completed sale is not reversed because the Account closes. Consigned Items that already have an Intake Verification Date keep any Promotion they qualified for, unless the closure is for a reason in Section 8.

7. Changing or Ending Promotions

7.1 Right to change. The Company may change, suspend, or end any Promotion Offer, or these Promotion Terms, at any time. This includes ending an offer before its stated end date if it was issued in error. Changes apply going forward only.

7.2 What the Company will honor. If a person accepted a Promotion before a change, the Company will honor it for Consigned Items shipped to the Company before the change took effect, under the Offer Details and these Promotion Terms as they stood when the person accepted it. Unused Consignment Credits already issued remain valid until their stated expiration date. The Company will not reverse a Promotion properly applied to a completed sale because it later changes or ends that Promotion.

7.3 Notice. The Company will post updated Promotion Terms on its website with a new effective date. For material changes affecting a person's existing Promotion, the Company will also notify the person by email. Where required by law, the Company will ask for the person's affirmative acceptance before a material change applies to them.

7.4 Abuse and fraud. Sections 7.1 and 7.2 do not limit the Company's rights under Section 8.

8. Abuse, Fraud, and Disqualification

8.1 Grounds. The Company may deny, cancel, or reverse any Promotion, and may take any action allowed under the Consignment Agreement, if it reasonably believes a consignor or anyone acting with them has:

  • opened multiple or related Accounts to obtain Promotions more than once

  • engaged in shill bidding as described in Section 3.6 of the Consignment Agreement, including bidding on or buying their own Consigned Items or arranging for others to do so

  • split, combined, or timed consignments mainly to gain a Promotion they would not otherwise receive

  • shipped items that do not match the items described when the Promotion was accepted

  • provided false information, or consigned items that are misrepresented, counterfeit, altered, or not owned by the consignor

  • used bots, scripts, AI agents, or other automated means to claim or enter Promotions

  • shared, sold, or published Promotion Codes not meant for public use, or used any Promotion Code in advertising or another promotion without the Company's written permission

  • otherwise violated the Consignment Agreement or Terms of Service

8.2 Recovery. If a Promotion is reversed under this section, the Company may deduct the value of the Promotion already applied from current or future payments under Section 6.7 of the Consignment Agreement, and will show the deduction on the settlement statement.

8.3 Review of decisions. A person at the Company reviews every decision to deny, cancel, or reverse a Promotion under this section. A consignor may dispute a decision under this section as provided in Section 11.2.

9. Taxes

9.1 Taxes on payouts. A Promotion reduces the Consignment Fee the Company charges, which increases the consignor's payout. Consignors are responsible for any taxes on their payouts. The Company will report payouts as required by law and does not provide tax advice.

10. Privacy and Promotion Information

10.1 Information used. To run Promotions, the Company uses the Promotion Codes entered, how a consignor learned of a Promotion, Promotion acceptance and redemption records, and the Account, consignment, and settlement information described in Section 1 of the Privacy Policy, including the "Promotion information" row of its chart. The Company does not use payout or tax information to run or market Promotions.

10.2 Purposes. The Company uses this information to confirm eligibility, apply Promotions accurately, show them on settlement statements, detect and prevent duplicate Accounts and abuse, enforce these Promotion Terms, understand how people find the Company, and measure and improve marketing activities, as described in Section 3 of the Privacy Policy.

10.3 Privacy Policy controls. All personal information connected with a Promotion is collected, used, shared, and kept as described in the Privacy Policy. Nothing in these Promotion Terms expands what the Company may do with personal information. Privacy requests, including requests about Promotion records, go to privacy@sccardscollectibles.com or the mailing address in Section 12.5, and are handled as described in Section 11 of the Privacy Policy.

10.4 Marketing messages. The Company may send Promotion Offers and other marketing by email and by text message, whether or not the recipient has ever consigned. Accepting a Promotion does not by itself sign anyone up for marketing emails or texts. Marketing emails are sent only to people who have subscribed or otherwise consented, and each includes an unsubscribe link. Marketing texts are covered by Section 10.5. A person can unsubscribe from marketing emails and from marketing texts separately, so opting out of one does not opt the person out of the other. Opting out of marketing does not end a consignment or affect a Promotion already accepted. Texts about a consignment application or a consignment under the Consignment Agreement are not marketing texts. Notices about a Promotion a person has already accepted, such as a credit balance or expiration notice, are account communications and may still be sent by email after the person unsubscribes from marketing emails. These practices follow Section 7 of the Privacy Policy.

10.5 Promotional texts. The Company sends Promotion Offers and other marketing by text message only to a person who has given separate, express written consent to receive them. That consent is given through an opt-in step the Company provides, such as an unchecked box in the consignor portal or on a sign-up form, or a keyword text to the Company's number, after a notice that says: the Company will send promotional texts, including Promotion Offers, to the mobile number provided and may use automated technology to send them; message frequency varies, and message and data rates may apply; the person can reply STOP at any time to opt out or HELP for help; and agreeing is not a condition of consigning, receiving a Promotion, or buying anything. The Company keeps a record of each consent, including the date and time, the phone number, and how it was given. Promotional texts are sent only between 8:00 a.m. and 9:00 p.m. in the recipient's local time, or within any narrower hours state law requires. A person can withdraw consent at any time by replying STOP or by any other reasonable means, such as emailing contact@sccardscollectibles.com. The Company will honor the request within the time the law requires and may send one message confirming it. A person who changes or gives up a mobile number should tell the Company. The Company does not share a person's mobile number or text-messaging information with third parties for their own marketing. This consent is separate from the consent to texts about a consignment in Section 15 of the Consignment Agreement. Section 24 of the Terms of Service also applies.

10.6 Marketplace contact information. The Company does not use contact information received through an eBay or other marketplace transaction to send Promotion Offers, unless the person has separately subscribed through a channel where consent is properly obtained. See Section 4 of the Privacy Policy.

10.7 Consignors outside the United States. For consignors in the European Economic Area, the United Kingdom, or Switzerland, Section 12 of the Privacy Policy also applies, and the Company sends them Promotion Offers only as local law permits.

10.8 Records. Promotion and credit records are kept for the period stated in Section 9 of the Privacy Policy. Text-message consent records, and offers and acceptances from people who never open an Account, are kept only as long as needed, as that section also provides.

11. Liability, Disputes, and Governing Law

11.1 No guarantee; liability. Section 3.2 (no guarantee of sale) and Section 13 (limitation of liability) of the Consignment Agreement apply to every Promotion. If a Promotion was missed or misapplied, the Company's responsibility is to correct it under Section 4.5.

11.2 Disputes. Questions or disputes about a Promotion should first be sent in writing to consignment@sccardscollectibles.com. Any dispute not resolved informally is subject to Section 11.3.

11.3 Governing law. These Promotion Terms are governed by the laws of the State of New Jersey, and any legal proceeding is brought in the courts named in Section 16 of the Consignment Agreement, or in small claims court if the claim qualifies.

11.4 Technical issues. The Company is not responsible if a Promotion Code cannot be entered or applied because of a technical problem outside its reasonable control.

11.5 Consumer rights. Nothing in these Promotion Terms waives a right a person has under applicable law that cannot be waived, including under New Jersey consumer-protection laws.

12. General Provisions and Acceptance

12.1 Entire terms. These Promotion Terms and the Offer Details are the full terms of a Promotion.

12.2 Severability. If any part of these Promotion Terms is found unenforceable, the rest remains in effect.

12.3 No waiver. The Company's failure to enforce any provision is not a waiver of its right to enforce it later.

12.4 Acceptance. By accepting a Promotion Offer, entering a Promotion Code, or consigning items under a Promotion, the recipient agrees to these Promotion Terms. The Company's electronic records, including portal activity, may be used as evidence of acceptance, as provided in Section 17.6 of the Consignment Agreement and Section 24 of the Terms of Service.

12.5 Contact. SC Cards & Collectibles LLC · P.O. Box 584, Cranford, NJ 07016 · Promotion questions: consignment@sccardscollectibles.com · Privacy requests: privacy@sccardscollectibles.com or the mailing address above · 848-332-3444

12.6 Notices. Notices about a Promotion are given as provided in Section 15 of the Consignment Agreement.

Schedule A: Consignment Credit Program

A.1 How a credit is earned. The Offer Details state how a Consignment Credit is earned and its dollar amount. Examples include a credit for a first consignment, for submitting a minimum number of Qualifying Items, or for using a specific Promotion Code. A Consignment Credit is issued free of charge as a promotion. It is not purchased and is not a gift card or stored-value product.

A.2 When a credit is issued. Unless the Offer Details say otherwise, a Consignment Credit is issued when the earning conditions are met and the related Consigned Items have an Intake Verification Date. The issue date, the amount applied, the remaining balance, and the expiration date will be shown on the consignor's settlement statement and in the consignor portal.

A.3 How a credit is applied. The Company applies the credit automatically against the Consignment Fee on each settled sale, in the order sales are settled, until the credit is used up or expires. The consignor cannot choose which sales receive the credit or defer its use.

A.4 Unused balance carries forward. If the credit is larger than the Consignment Fee on a sale, the remaining balance carries forward to later sales until it expires.

A.5 Example. A consignor has a $25.00 credit. An item sells for a gross sale price of $46.00, which places it in the Core tier (15%), and its Net Sale Proceeds are $40.00 after marketplace and payment processing fees. The Consignment Fee is $6.00 (15% of $40.00). The credit covers the $6.00 Consignment Fee, the consignor is paid the full $40.00, and $19.00 of credit remains.

A.6 Expiration. A Consignment Credit expires as stated in Section 5.6, and any balance unused at expiration is forfeited.

Schedule B: Consignment Fee Discount Program

B.1 How the discount works. A Consignment Fee Discount reduces the standard Consignment Fee rate by the percentage stated in the Offer Details.

B.2 Tiers are set first. A discount is applied after the item's tier is set. It does not move an item into a different tier or change any tier threshold.

B.3 Excluded tiers. Unless the Offer Details say otherwise, a Consignment Fee Discount does not apply to items in the Elite and Signature tiers.

B.4 Which sales qualify. Unless the Offer Details say otherwise, the discount applies to a Qualifying Item only if it qualifies under Section 4.3 and its sale closes during the Promotion Period or within 30 days after it ends. Items sold after that receive the standard rate.

B.5 Example. A 20% discount would change the standard rates as follows:

Tier Standard rate Discounted rate
Core 15% 12%
Select 12.5% 10%
Premium 10% 8%
Premier 6.5% 5.2%
Elite 5% Not discounted
Signature 3% Not discounted
