Terms of service
These Terms of Service ("Terms") govern your access to and use of the website located at sccardscollectibles.com (the "Site"), including purchases made directly through the Site.
The Site is operated by SC Cards & Collectibles LLC, a New Jersey limited liability company ("SC Cards & Collectibles," "SC Cards," "we," "us," or "our").
By accessing the Site, creating an account, placing an order, or otherwise using the Site, you agree to be bound by these Terms and by any additional policies referenced in these Terms, including our Privacy Policy, Refund Policy, and Shipping Policy.
If you do not agree to these Terms, you should not use the Site or place an order through it.
1. ELIGIBILITY AND USE OF THE SITE
The Site is intended for a general audience.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement, or have reached the age of majority in your jurisdiction if the applicable age of majority is higher, to create a customer account or place an order through the Site.
If you are under the applicable age of majority, a parent or legal guardian must create the account and place any order on your behalf.
The Site is not directed to children under 13. Additional information regarding children’s privacy is provided in our Privacy Policy.
You agree to use the Site only for lawful purposes and in accordance with these Terms.
2. OUR ONLINE STORE AND SHOPIFY
Our online store is hosted and supported by Shopify, which provides ecommerce technology used to operate the Site and process certain transactions.
Purchases made directly through the Site are transactions between you and SC Cards & Collectibles unless otherwise expressly stated. Shopify and other third-party providers may separately provide payment processing, account services, security features, analytics, and related technology.
Your use of certain third-party functionality may also be subject to the applicable provider’s own terms and policies.
3. PRODUCTS AND COLLECTIBLES
SC Cards & Collectibles sells trading cards, sports cards, memorabilia, collectibles, and related products.
Many of the products we sell are unique, limited in quantity, previously owned, collectible, or subject to changes in market availability and value.
We make reasonable efforts to accurately display and describe each item. However, photographs, scans, images, colors, dimensions, print characteristics, and other product details may appear differently depending on lighting, photography, display settings, equipment, or other factors.
Unless expressly stated otherwise, photographs of individually listed collectible items are intended to depict the actual item being offered for sale.
If a stock, manufacturer, or representative image is used instead of an image of the specific collectible being sold, we will identify it as a representative image.
You are responsible for reviewing the complete listing, photographs, description, condition information, price, certification information where applicable, and other available information before purchasing.
4. CARD CONDITION, GRADING, AUTHENTICATION, AND ITEM PRESERVATION
Raw and Ungraded Cards
The condition of raw or ungraded trading cards is inherently subjective.
Unless a listing expressly states otherwise, any condition description provided by SC Cards & Collectibles represents our reasonable assessment of the item based on visible characteristics and available information at the time of listing.
Raw cards may contain manufacturing or handling characteristics including surface imperfections, print lines, scratches, edge wear, corner wear, centering variations, whitening, dimples, indentations, roller marks, print defects, or other characteristics that may affect condition or grading.
Photographs form part of the item description and should be reviewed carefully before purchase.
SC Cards & Collectibles does not guarantee that any raw or ungraded card will receive any particular grade, designation, qualification, or determination from PSA, SGC, Beckett/BGS, CGC, or any other grading or authentication company.
A purchaser’s expectation regarding a potential future grade does not modify the condition represented in the applicable listing.
Graded and Authenticated Items
Certain products may have been graded, authenticated, encapsulated, certified, or otherwise evaluated by independent third-party companies, including PSA, SGC, Beckett/BGS, CGC, or other grading or authentication providers.
Any grade, certification, designation, opinion, or authentication attributed to such a company represents the determination of that third party and not an independent guarantee by SC Cards & Collectibles.
For an individually listed graded or authenticated collectible, the identity of the item may be established by the combination of the applicable listing photographs, grading or authentication company, grade or designation, certification number where displayed, and listing description.
Unless expressly stated otherwise in the listing, SC Cards & Collectibles does not independently warrant:
-
that a third-party grade will remain unchanged;
-
that another grading company would assign the same grade;
-
that the same grading company would assign the same grade if the item were cracked, resubmitted, reviewed, or regraded;
-
any future population-report status; or
-
any future determination made by a grading or authentication company.
Where available, customers should review certification numbers, photographs, labels, holders, and third-party certification information before purchasing.
Nothing in this section limits our responsibility to accurately identify and describe the graded or authenticated item being offered for sale.
Item Preservation, Alteration, and Tampering
If you believe an item was materially misrepresented, incorrectly shipped, damaged, or otherwise qualifies for a claim under our Refund Policy or applicable law, you should preserve the item substantially in the condition in which it was received while the claim is reviewed.
For graded or encapsulated items, cracking, opening, removing, replacing, modifying, altering, or tampering with a grading holder, authentication holder, certification label, security feature, or collectible may affect eligibility for a return, refund, or other remedy.
For raw or ungraded cards, materially altering, cleaning, trimming, pressing, restoring, recoloring, modifying, or submitting the card for grading or authentication before a condition-related claim is resolved may affect eligibility for a return, refund, or other remedy.
5. COLLECTIBLE VALUES AND MARKET FLUCTUATIONS
Trading cards and collectibles can experience significant and rapid changes in market value.
Values may be affected by factors including player performance, injuries, popularity, product releases, supply, scarcity, grading populations, market demand, economic conditions, auction results, hobby trends, and other factors outside our control.
SC Cards & Collectibles does not guarantee the future value, resale value, liquidity, appreciation, investment performance, marketability, or continued demand for any item.
Any prices, historical sales information, comparable sales, market information, or other data displayed or referenced through the Site are provided for informational purposes and do not constitute financial or investment advice.
Your decision to purchase a collectible is your own.
A later increase or decrease in market value does not by itself entitle either party to cancel, reverse, or modify a completed transaction.
6. PRICING, DESCRIPTIONS, AND AVAILABILITY
Prices and product availability are subject to change without notice before an order is accepted as described in Section 7.
We make reasonable efforts to ensure that product listings, prices, images, specifications, inventory information, and descriptions are accurate. However, errors may occasionally occur.
Before an order has been accepted, we reserve the right to correct typographical errors, incorrect prices, inaccurate descriptions, technical errors, inventory errors, or other listing mistakes and to decline or cancel an affected order.
If an item is listed at an obviously incorrect price or on materially incorrect terms due to human error, software error, data-feed error, integration error, or other mistake, we may decline or cancel the affected order before acceptance and refund any amounts collected for the canceled item.
After an order has been accepted, we may correct informational errors, but cancellation or modification of the transaction will occur only as expressly permitted by these Terms or applicable law.
We do not undertake an obligation to update every historical reference to prices, market information, or product availability appearing elsewhere on the Site.
7. ORDER SUBMISSION AND ACCEPTANCE
Submitting an order through the Site constitutes an offer to purchase the identified item or items.
An automated order confirmation, payment authorization, confirmation email, or similar electronic communication acknowledges that we received your order but does not constitute final acceptance of that order.
Unless we expressly state otherwise, our acceptance of an order occurs when we send you a shipment confirmation, otherwise expressly confirm that the order has been accepted for fulfillment, or deliver the item, whichever occurs first.
Before acceptance, an order may be subject to inventory confirmation, payment verification, fraud screening, address verification, product availability, and other reasonable review.
Before acceptance, we may decline or cancel an order where:
-
the item is no longer available;
-
the item was previously sold through another authorized sales channel;
-
inventory was incorrectly displayed;
-
a pricing or listing error occurred;
-
payment cannot be verified;
-
we reasonably suspect unauthorized, fraudulent, abusive, or unlawful activity;
-
an order violates applicable purchase limits or policies;
-
fulfillment is prohibited by law; or
-
another material error prevents us from completing the transaction as represented.
After an order has been accepted, we may cancel or modify the transaction only where expressly permitted by these Terms or applicable law.
If we cancel an order after collecting payment, we will refund the applicable amount collected for the canceled item.
8. CROSS-LISTED AND UNIQUE INVENTORY
Because many trading cards and collectibles are unique items with an available quantity of one, certain products may be offered simultaneously through the Site and through third-party marketplaces or sales channels, including eBay.
We use reasonable operational and technical measures to synchronize inventory across sales channels. However, synchronization may not always occur instantaneously.
Delays may result from inventory synchronization delays, marketplace processing delays, system outages, software errors, simultaneous purchases, or other circumstances outside our reasonable control.
If the same unique item is ordered through more than one channel before acceptance, we may decline or cancel the later unavailable order based on the timing and status of the applicable transactions.
If a synchronization or system error results in more than one accepted transaction for the same unique item and it is impossible to fulfill each transaction, we may determine which transaction will be fulfilled based on reliable transaction records and timestamps. Any customer whose accepted order cannot be fulfilled because of such a duplicate-sale error will receive a prompt refund of all amounts collected for that item, together with any additional remedy required by applicable law.
In determining transaction timing, inventory availability, order priority, payment status, or the sequence of transactions involving unique or cross-listed inventory, we may reasonably rely on electronic records generated by our Site, Shopify, payment processors, eBay, marketplace integrations, shipping systems, and other relevant technology providers. These records may include transaction timestamps, order logs, payment records, inventory updates, marketplace records, and related system information.
Where records from different systems reflect different processing times, we may reasonably evaluate the available records and transaction circumstances to determine which transaction can be fulfilled. Nothing in this section prevents a customer from presenting evidence of a technical or transactional error.
The existence of an automated order confirmation or temporary payment authorization does not require us to deliver an item that had already been sold and was unavailable before acceptance.
9. THIRD-PARTY MARKETPLACES, INCLUDING EBAY
The Site may display, reference, promote, or link to products that are offered through third-party marketplaces, including eBay.
A transaction completed directly through a third-party marketplace is not a purchase completed through the SC Cards & Collectibles Shopify checkout.
For example, if you select a link such as “View on eBay,” “Buy on eBay,” “Ending Soon on eBay,” or similar functionality and complete the transaction through eBay, that transaction is subject to the terms, policies, buyer protections, payment requirements, authentication programs, return rules, seller policies, and other requirements applicable to that eBay transaction.
This may include, where applicable, the eBay User Agreement, eBay Money Back Guarantee, eBay Authenticity Guarantee, and policies contained in the individual listing.
These Terms do not override mandatory terms governing a transaction completed through a third-party marketplace.
Similarly, purchasing an item directly through the SC Cards & Collectibles Site does not automatically entitle the purchaser to protections or programs offered only for transactions completed through eBay or another third-party marketplace.
10. PAYMENTS, FRAUD PREVENTION, AND VERIFICATION
You agree to provide current, complete, and accurate billing, payment, shipping, and account information for purchases made through the Site.
You represent that you are authorized to use any payment method submitted in connection with an order.
Payments may be processed by Shopify Payments or other third-party payment providers.
We may use reasonable verification and fraud-prevention procedures before accepting or fulfilling an order and may decline transactions that we reasonably believe involve unauthorized payment methods, fraudulent activity, identity misuse, payment manipulation, chargeback abuse, or other improper conduct.
We are not obligated to ship, release, or otherwise transfer possession of a collectible until all amounts due for the applicable transaction have been successfully authorized and, where appropriate, received in cleared funds.
A pending payment, temporary authorization, payment-processing notification, or unverified transfer does not necessarily constitute final or cleared payment. If a payment is reversed, rejected, canceled, disputed, or determined to be unauthorized before fulfillment, we may suspend or cancel the transaction.
For certain transactions, particularly high-value or unusual orders, we may require reasonable additional verification before accepting or fulfilling the order. Verification may include confirmation of identity, billing information, shipping information, payment authorization, contact information, or other information reasonably necessary to prevent fraud, unauthorized purchases, or delivery errors.
We may request documentation or additional confirmation where reasonably appropriate. Any personal information collected for verification purposes will be handled in accordance with our Privacy Policy and applicable law.
We may also require signature confirmation, insured shipping, restricted delivery, or other enhanced delivery procedures for certain transactions.
Failure to complete reasonably requested verification may result in delay or cancellation of the applicable order. If an order is canceled after payment has been collected, the applicable amount will be refunded.
11. PURCHASE AND QUANTITY LIMITS
We may establish reasonable purchase limits for particular products, promotions, releases, customers, households, accounts, payment methods, billing addresses, shipping addresses, or other reasonably related categories.
Where a purchase limit is stated, you may not attempt to circumvent that limit through multiple accounts, identities, addresses, payment methods, coordinated purchases, or other means.
We may cancel or adjust orders that we reasonably determine violate a disclosed purchase limit or involve abuse of a promotion or purchasing restriction.
Unless expressly stated otherwise, purchasing an item for resale is not prohibited solely because the purchaser is a dealer, collector, investor, or reseller.
12. PROMOTIONS, DISCOUNTS, AND COUPON CODES
From time to time, we may offer promotions, discounts, coupon codes, credits, special pricing, loyalty benefits, or other promotional programs.
Promotions may be subject to additional terms, including eligibility requirements, purchase thresholds, product exclusions, expiration dates, quantity limits, geographic restrictions, or other conditions disclosed in connection with the promotion.
Unless expressly stated otherwise:
-
promotional offers may not be combined;
-
discounts have no cash value;
-
promotional benefits may not be transferred or resold;
-
promotions may exclude certain products or transactions; and
-
promotions may be modified, suspended, or discontinued prospectively.
We may cancel or correct promotional benefits obtained through fraud, technical error, misuse, circumvention of disclosed restrictions, or other material abuse.
We will not retroactively revoke a properly applied promotion after a completed transaction solely because we later change or discontinue the promotion.
13. TAXES
Applicable sales tax or other transaction-based taxes may be calculated and collected based on applicable law, the shipping destination, product type, marketplace requirements, or other relevant factors.
You are responsible for any taxes, duties, fees, or charges legally applicable to your transaction except to the extent we are legally required to collect and remit them.
14. SHIPPING AND DELIVERY
Shipping methods, processing times, carrier options, costs, delivery practices, and other fulfillment terms are described in our Shipping Policy or during checkout.
We will make reasonable efforts to ship an order within the shipping timeframe represented at the time of purchase or within another timeframe required by applicable law.
If we are unable to ship an order within an applicable represented or legally required timeframe, we will provide any notice, opportunity to consent to a delay, cancellation right, or refund required by applicable law.
Any stated carrier delivery date or delivery window after shipment is an estimate unless expressly identified as guaranteed.
We are not responsible for carrier delays caused by severe weather, natural disasters, customs, government action, transportation disruptions, incorrect customer information, or other circumstances outside our reasonable control, subject to any responsibility imposed on us by applicable law.
If a package is lost, damaged, delayed, or misdelivered, the rights and responsibilities of the parties will be determined under our Shipping Policy, applicable carrier procedures, applicable marketplace rules where relevant, and applicable law.
15. INTERNATIONAL ORDERS, CUSTOMS, AND TRADE RESTRICTIONS
If we offer international shipping, availability may vary by destination, product, carrier, marketplace, payment method, or applicable law.
International purchasers are responsible for providing accurate shipping and customs information and for any duties, import taxes, customs charges, brokerage fees, or similar amounts not expressly collected by us at checkout.
International transactions may be subject to export controls, economic sanctions, trade restrictions, customs regulations, or other legal requirements.
We may decline or cancel an order where shipment, payment, or delivery would violate applicable law, governmental restrictions, carrier requirements, or payment-provider requirements.
Nothing in these Terms requires SC Cards & Collectibles to offer international shipping to any particular destination.
16. RETURNS, REFUNDS, AND CANCELLATIONS
Returns, refunds, exchanges, order cancellations, damaged-item claims, and related matters are governed by our Refund Policy, which is incorporated into these Terms by reference.
Because collectible values may fluctuate, cancellation or return rights are not created merely because an item’s market value changes after purchase.
17. CONSIGNMENT, PURCHASING, AND OTHER SERVICES
If and when we offer consignment services, purchases of collectibles from customers or consignors, seller services, consignor accounts, consignor dashboards, trade-ins, or similar programs, those services may be governed by separate agreements, fee schedules, disclosures, policies, or program terms.
Where separate terms apply to a particular service, those terms will govern that service to the extent of any conflict with these Terms.
Nothing contained in these Terms creates a consignment relationship between you and SC Cards & Collectibles unless we separately agree to such a relationship.
18. CUSTOMER ACCOUNTS
Certain Site features may permit or require you to create or use an account.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account to the extent permitted by law.
You agree to provide accurate information and promptly update information that becomes inaccurate.
We may suspend or terminate accounts associated with fraud, abuse, attempts to circumvent purchase restrictions, unauthorized access, misuse of the Site, or material violations of these Terms.
19. CUSTOMER REVIEWS, SUBMISSIONS, AND USER CONTENT
The Site may allow customers to submit reviews, ratings, photographs, comments, feedback, questions, testimonials, or other content (“User Content”).
You retain any ownership rights you may have in your User Content.
By submitting User Content for publication through the Site, you grant SC Cards & Collectibles a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, distribute, and use that content in connection with operating, promoting, and improving our business and Site, subject to our Privacy Policy and applicable law.
You represent that you have the right to submit the User Content and that it does not violate applicable law or the rights of another person.
User Content may not contain material that is unlawful, fraudulent, defamatory, threatening, harassing, obscene, infringing, deceptive, malicious, or unrelated to the applicable product or service.
We may moderate, refuse, or remove User Content where we reasonably determine that it violates these Terms, applicable law, or reasonable Site standards.
We do not require reviews to be favorable and will not remove legitimate criticism solely because it is negative.
Nothing in these Terms restricts your right to provide an honest review of our products, services, or conduct.
Nothing in this section transfers ownership of a customer’s original intellectual property to SC Cards & Collectibles.
20. PROHIBITED USES
You may not use the Site:
-
for any unlawful or fraudulent purpose;
-
to impersonate another person or misrepresent your identity;
-
to submit false payment or shipping information;
-
to interfere with the security or operation of the Site;
-
to introduce malicious code, malware, viruses, or harmful technology;
-
to access nonpublic portions of our systems without authorization;
-
to scrape, crawl, harvest, reproduce, or systematically extract Site content or data through automated means except as permitted by law or with our written authorization;
-
to circumvent technological measures or access restrictions;
-
to infringe our intellectual property or the rights of others;
-
to engage in chargeback fraud, return fraud, payment fraud, promotional abuse, or other abusive purchasing practices; or
-
to use Site information to facilitate unlawful or deceptive activity.
We may restrict access to the Site where we reasonably believe these Terms have been materially violated.
21. INTELLECTUAL PROPERTY
The Site and its content, including our business name, logos, branding, graphics, photographs, product photography, written descriptions, website design, text, graphics, and other original materials, are owned by or licensed to SC Cards & Collectibles and are protected by applicable intellectual-property laws.
“SC Cards & Collectibles,” our logos, and associated branding may not be used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without our prior written consent.
Third-party trademarks, team names, league names, player names, card-manufacturer names, grading-company names, marketplace names, and other third-party intellectual property remain the property of their respective owners.
The sale of an item does not transfer any copyright, trademark, publicity, licensing, reproduction, or other intellectual-property rights associated with the subject of that item.
22. THIRD-PARTY SERVICES AND LINKS
The Site may rely on or link to services operated by third parties, including Shopify, payment processors, shipping carriers, eBay, social-media platforms, analytics providers, grading companies, authentication providers, and other service providers.
Third parties control their own services, policies, availability, security practices, and content, and your use of those services may be subject to separate terms and privacy policies established by the applicable provider.
We are not responsible for independent acts or omissions of third parties that are outside our reasonable control.
However, this section does not eliminate any responsibility SC Cards & Collectibles may have under applicable law for services or providers we choose to use in connection with our transactions with customers.
A link to a third-party website or service does not constitute an endorsement unless expressly stated.
23. PRIVACY
Our collection, use, disclosure, and handling of personal information are described in our Privacy Policy.
By using the Site, you acknowledge that you have access to our Privacy Policy and understand that personal information may be processed as described there and as permitted by applicable law.
24. ELECTRONIC COMMUNICATIONS
When you use the Site, place an order, create an account, or communicate with us electronically, you consent to receiving transactional communications from us electronically, including through email and Site-based communications.
Electronic communications may include order confirmations, receipts, shipping notifications, customer-service responses, account notices, policy updates, security notices, and other communications relating to your transactions or use of the Site.
Marketing communications will be handled in accordance with applicable law and our Privacy Policy.
You are responsible for maintaining a valid email address and reviewing communications relating to your orders.
25. DISCLAIMER OF WARRANTIES
The Site and its general content are provided on an “as available” basis.
Except for representations expressly made in an applicable product listing or rights provided by law, we do not guarantee uninterrupted operation of the Site, absence of technical errors, continued availability of a particular product, future collectible value, or future grading results.
26. LIMITATION OF LIABILITY
Except where prohibited by applicable law, SC Cards & Collectibles and its members, managers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to your use of the Site or a transaction with us, including loss of anticipated profits, investment gains, collectible appreciation, business opportunities, or data.
Except where prohibited by applicable law, our aggregate liability arising from a particular purchase or transaction will not exceed the amount you actually paid to SC Cards & Collectibles for the product or transaction giving rise to the claim.
These limitations do not apply to fraud, gross negligence, willful misconduct, or to personal injury, statutory damages, attorneys’ fees, consumer remedies, or other liability, rights, or remedies to the extent applicable law does not permit them to be excluded or limited.
Nothing in this section limits any non-waivable remedy available under applicable consumer-protection law.
27. INDEMNIFICATION
You agree to indemnify and hold harmless SC Cards & Collectibles LLC and its members, managers, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable expenses arising directly from:
-
your knowing or intentional material violation of these Terms;
-
your fraudulent or unlawful use of the Site;
-
your knowing infringement of another person’s rights; or
-
User Content or information you knowingly submit in violation of applicable law or third-party rights.
This section does not require you to indemnify SC Cards & Collectibles for our own negligence, fraud, willful misconduct, unlawful conduct, or other liability that cannot legally be shifted to you.
28. SERVICE INTERRUPTIONS AND FORCE MAJEURE
We will not be responsible for a delay or failure to perform caused by circumstances beyond our reasonable control, including severe weather, natural disaster, fire, flood, labor disruption, carrier interruption, internet outage, payment-network failure, cyberattack, governmental action, marketplace outage, Shopify outage, eBay outage, software failure, telecommunications interruption, supply-chain disruption, or similar event.
This section does not excuse any refund or other remedy required by applicable law.
29. TERMINATION AND SUSPENSION
We may suspend or terminate your access to the Site for material violations of these Terms, fraud, abuse, unauthorized activity, security concerns, or unlawful conduct.
Termination or suspension does not eliminate rights or obligations that arose before termination.
Provisions that by their nature should survive termination, including provisions relating to intellectual property, completed transactions, disclaimers, limitations of liability, indemnification, and dispute resolution, will survive.
30. NEW JERSEY AND OTHER CONSUMER RIGHTS
Nothing in these Terms is intended to waive, limit, disclaim, or require you to surrender any consumer right or remedy that applicable law does not permit to be waived.
For New Jersey consumers, nothing in these Terms is intended to waive or limit any non-waivable rights or remedies available under the New Jersey Consumer Fraud Act, the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act, or other applicable New Jersey consumer-protection laws.
If any provision of these Terms conflicts with a clearly established non-waivable consumer right, the applicable consumer right will control to the extent of that conflict.
31. GOVERNING LAW AND DISPUTES
These Terms and transactions completed directly through the Site will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer-protection law provides otherwise.
Before commencing formal litigation, we encourage you to contact us at contact@sccardscollectibles.com so that we can attempt to resolve the matter.
Subject to applicable law, any legal action arising from these Terms or a transaction completed directly through the Site shall be brought in a state or federal court having jurisdiction in New Jersey.
Nothing in this section prevents either party from pursuing rights or remedies in another forum where applicable law gives that party a non-waivable right to do so.
32. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or, where appropriate, severed from these Terms.
The remaining provisions will continue in effect.
33. WAIVER
Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.
Any waiver must be made expressly and will apply only to the circumstances for which it is given.
34. ENTIRE AGREEMENT AND ORDER OF PRECEDENCE
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, applicable product listing, applicable promotional terms, and other policies expressly incorporated by reference, constitute the agreement governing your use of the Site and purchases made directly through the Site.
If there is a direct conflict concerning a particular transaction or issue, the more specific applicable terms will control over these general Terms with respect to that issue.
Accordingly:
-
specific terms contained in an applicable product listing govern matters unique to that item;
-
specific promotional or program terms govern the applicable promotion or program;
-
the Refund Policy governs returns, refunds, exchanges, and related claims;
-
the Shipping Policy governs shipping and delivery matters; and
-
the Privacy Policy governs our collection, use, disclosure, and handling of personal information.
Separate written agreements governing services such as consignment, purchasing, seller services, or other programs control with respect to the services expressly covered by those agreements.
For purchases completed through eBay or another third-party marketplace, the applicable marketplace transaction terms and listing terms govern as described in Section 9.
35. CHANGES TO THESE TERMS
We may revise these Terms from time to time to reflect changes in our business, Site functionality, legal requirements, third-party services, or operating practices.
The current version will be posted on the Site with an updated Effective Date.
Changes will apply prospectively.
Unless applicable law requires otherwise, a purchase made through the Site will be governed by the version of these Terms in effect when the applicable order was submitted.
Material changes may also be communicated through the Site, a customer account, email, or another reasonable method.
Where appropriate or required by applicable law, we may request affirmative acceptance of materially revised Terms before they apply to future transactions or continued use of affected Site functionality.
We will not rely solely on a customer’s prior acceptance of an earlier version of these Terms to impose a materially different contractual obligation where renewed assent is required by applicable law.
